Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Shortlisted Pty Ltd ACN [pending registration] ("Shortlisted", "we", "our", "us"), governing your access to and use of the Shortlisted platform available at getshortlisted.com.au and any related services (collectively, the "Service").

By creating an account, placing an order, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

Shortlisted is an AI-powered platform designed to help individuals create professional, ATS-optimised CVs and related job application documents. The Service includes:

• CV creation via file upload (we extract and enhance your existing CV) or manual build (you enter your experience step by step)
• AI-powered content enhancement to improve clarity, impact, and keyword optimisation
• Template selection and document formatting (standard and premium templates available)
• Optional add-ons including AI-generated cover letters and LinkedIn profile rewrites
• Document delivery in PDF and DOCX format

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

To use the Service you must create an account. You agree to:

• Provide accurate, current, and complete information when registering
• Maintain the security of your password and not share your account credentials
• Notify us immediately at hello@getshortlisted.com.au if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

Each account is for a single individual's personal use. You may not use your account to build CVs or documents for other people on a commercial basis without our prior written consent. Resellers, recruiters, or agencies wishing to use the Service at volume should contact us at hello@getshortlisted.com.au to discuss a business arrangement.

You agree to use the Service only for its intended purpose — creating legitimate professional documents for your own job search. You must not:

• Use the Service to create fraudulent, misleading, or defamatory content
• Upload content that is unlawful, abusive, discriminatory, or infringes a third party's rights
• Attempt to reverse-engineer, scrape, copy, or reproduce any part of the Service or its underlying technology
• Use automated tools, bots, or scripts to interact with the Service
• Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure
• Use the Service in any way that could damage, overburden, or impair its normal operation
• Resell, sublicense, or otherwise commercialise the Service or Documents without our express written permission
• Upload viruses, malware, or any other harmful code

We reserve the right to terminate or suspend your account if we believe, in our sole discretion, that you have breached this acceptable use policy.

Your content: You retain full ownership of all content you upload or input into the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to process your content for the sole purpose of providing the Service to you. We do not claim ownership of your personal data or work history.

Your documents: Once your Order is complete and payment is received, you own the Documents we generate for you. You may use them freely for personal job search purposes.

Our platform: All other content on the Shortlisted platform — including software, templates, design, branding, marketing copy, and methodology — is owned by or licenced to Shortlisted Pty Ltd. Nothing in these Terms transfers any ownership of our platform to you.

Shortlisted uses AI tools to help draft, enhance, and structure your Documents. You understand and agree that:

• AI output requires your review. AI-generated content may contain inaccuracies, omissions, or language that doesn't precisely reflect your experience. You are responsible for reviewing, editing, and approving all content before submitting it to employers.
• You are responsible for accuracy. Submitting your Documents to employers with false or misleading information is your sole responsibility. Shortlisted accepts no liability for the consequences of inaccurate content in your Documents, including rejection, rescinded offers, or employment termination.
• AI cannot guarantee outcomes. We do not guarantee that use of our Service will result in interview invitations, job offers, or any other employment outcome. The Australian job market is complex and outcomes depend on many factors beyond document quality.
• No legal or professional advice. Nothing generated by our Service constitutes legal, financial, career, or professional advice. If you need guidance specific to your circumstances (e.g., visa or licensing requirements), seek qualified professional advice.

Pricing

All prices are in Australian dollars and include GST. Payment is processed securely through Stripe. We do not store your card details.

Refund policy

Because Shortlisted delivers digital content, our refund policy is designed to be fair while accounting for the fact that AI processing is performed on your order:

• Before download: If you have not downloaded or accessed your Documents, you may request a full refund within 7 days of purchase by contacting hello@getshortlisted.com.au.
• After download: Once you have downloaded your Documents, refunds are generally not available, as the digital product has been delivered. Exceptions may be made at our discretion if there is a significant error attributable to our platform.
• Technical failures: If you experience a genuine technical failure preventing document delivery, please contact us. We will either resolve the issue or provide a full refund.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms and is incorporated by reference.

By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The Privacy Policy covers, among other things:

• What personal information we collect and why
• How your CV data is processed by our AI systems
• Third-party service providers (including Stripe, AI providers, and our hosting infrastructure)
• Your rights under the Privacy Act 1988 (Cth) and Australian Privacy Principles
• How to make an access, correction, or deletion request

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate, complete, or reliable
• Any errors or defects in the Service will be corrected
• The Service is free from viruses or other harmful components

We do not warrant that using our Service will improve your employment outcomes. The Australian job market and individual hiring decisions are outside our control.

Certain rights and warranties are implied by Australian Consumer Law and cannot be excluded. Nothing in these Terms affects those non-excludable rights.

To the maximum extent permitted by law, Shortlisted's total liability to you for any claim arising out of or in connection with the Service — whether in contract, tort (including negligence), statute, or otherwise — is limited to the amount you paid for the Order giving rise to the claim.

In no event will Shortlisted be liable for:

• Loss of income, revenue, profits, or anticipated savings
• Loss of data or documents (beyond re-delivery of your Order)
• Loss of business, opportunity, or goodwill
• Indirect, incidental, special, consequential, or punitive damages
• Any loss arising from your reliance on AI-generated content that you did not adequately review

You agree to indemnify, defend, and hold harmless Shortlisted Pty Ltd, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the Service
• Content you upload or provide that is false, misleading, defamatory, or infringes a third party's rights
• Your breach of these Terms
• Your violation of any applicable law or regulation
• Any claim by a third party (such as an employer) arising from inaccuracies in your Documents that you approved for submission

We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in conduct we consider harmful to other users or the platform, or if we are required to do so by law.

You may delete your account at any time from within your account settings or by emailing hello@getshortlisted.com.au. Deletion of your account does not entitle you to a refund unless you meet the refund criteria in Section 8.

On termination:

• Your right to access the Service ceases immediately
• We will retain your data in accordance with our Privacy Policy retention schedule
• Completed Orders and downloaded Documents remain yours to keep
• Sections 6, 7, 10, 11, 12, and 15 survive termination

We may update these Terms from time to time. When we do, we will:

• Update the "Effective" date at the top of this page
• Notify you by email at least 14 days before material changes take effect
• Require you to accept updated Terms on your next login if the changes materially affect your rights

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you disagree with any changes, your remedy is to stop using the Service and delete your account.

Minor changes (such as corrections to typos or updates to contact information) may be made without notice.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflicts of law principles. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

If a dispute arises between you and Shortlisted, we both agree to first attempt to resolve it informally by contacting us at hello@getshortlisted.com.au. We will use reasonable efforts to resolve the dispute within 30 days.

If the dispute cannot be resolved informally, either party may pursue their rights through the courts or, where applicable, through the Australian Competition and Consumer Commission (ACCC) or the relevant state fair trading body.
